1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and TraxinteL, Inc., a New York corporation ("Company," "we," "us," or "our"), governing your access to and use of TraxinteL.com (the "Website") and all related services, tools, reports, and features (collectively, the "Service").

By creating an account, accessing the Website, or using the Service, you expressly agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms.

2. Service Description

TraxinteL provides open-source intelligence (OSINT) research services that analyze publicly available online information to help users locate digital traces, online activity, and signals connected to individuals they are searching for ("Target"). Our Service includes:

  • Deep Search: Comprehensive one-time investigation using 500+ public data sources
  • Continuous Monitoring: Ongoing subscription-based surveillance of specified Targets with real-time alerts
  • Analysis & Reporting: Fusion intelligence engine analysis, confidence scoring, and PDF report generation

Critical Limitations: The Service:

  • Analyzes ONLY publicly available information
  • Does NOT access, hack, or bypass private accounts or security systems
  • Does NOT contact or notify Targets
  • Does NOT extract private data from protected accounts
  • Does NOT perform illegal surveillance or unauthorized monitoring
  • Does NOT conduct financial fraud, identity theft, or harassment

3. Eligibility & Account Requirements

To use the Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have legal capacity to enter into a binding contract
  • Reside in a jurisdiction where the Service is legal and not restricted
  • Provide accurate, current, and complete registration information
  • Maintain the confidentiality of your account credentials

Minors may not use the Service. If we become aware that you are under 18, we will immediately terminate your account.

4. Lawful Use Requirements

You represent and warrant that you will use the Service ONLY for lawful, legitimate purposes consistent with all applicable federal, state, local, and international laws, regulations, and ordinances. You specifically certify that you will NOT use the Service to:

  • Stalk, harass, threaten, abuse, defame, or harm any individual
  • Conduct unauthorized surveillance or monitoring in violation of applicable law
  • Blackmail, extort, or coerce any person
  • Commit identity theft, fraud, or financial crimes
  • Violate any person's privacy, publicity, or other legal rights
  • Violate intellectual property, copyright, or trademark laws
  • Reverse-engineer, attack, hack, or compromise our systems
  • Circumvent security measures, use unauthorized access, or exceed permitted access
  • Interfere with the Service's functionality or availability
  • Upload malware, viruses, or malicious code
  • Violate the Children's Online Privacy Protection Act (COPPA) or similar laws
  • Assist others in conducting any unlawful activity

5. User-Provided Information & Representations

You may upload photographs, names, usernames, email addresses, phone numbers, social media handles, documents, or other information related to the Target ("User Data"). You represent and warrant that:

  • You have lawful right and authority to provide this information
  • All User Data is accurate, truthful, and not misleading
  • Your use of this information complies with all applicable laws
  • You have obtained necessary consents from affected parties
  • The information does not infringe third-party intellectual property rights
  • The information does not contain confidential or trade secret information
  • The information does not expose us to legal liability

6. Acceptable Legitimate Uses

The Service is designed for legitimate purposes including, but not limited to:

  • Family safety and missing persons investigations
  • Background verification for employment, housing, or partnerships
  • Reconnecting with lost contacts or old acquaintances
  • Due diligence and Know Your Customer (KYC) compliance
  • Personal safety assessments and digital footprint analysis
  • Fraud detection and prevention
  • Legal proceedings and investigations (with proper authorization)
  • Self-awareness and personal digital profile review

7. Reports, Findings & Accuracy Disclaimer

AS-IS BASIS: All reports, findings, and information provided through the Service are generated from publicly available sources and provided on an "as-is" and "as-available" basis. We make NO warranties regarding accuracy, completeness, timeliness, or reliability.

Limitations:

  • Findings may be incomplete, outdated, or superseded by more recent information
  • False matches and false positives may occur despite our quality controls
  • Not all public data is indexed or accessible within our search parameters
  • Confidence scores are algorithmic estimates, not guarantees
  • We do not make personal identifications or render legal conclusions
  • Results should be independently verified before relying upon them

You acknowledge that investigation results are investigative aids only and should not be used as sole evidence in legal proceedings without proper authentication and expert testimony.

8. Payment Terms & Billing

Pricing & Currency: All prices are in USD unless otherwise stated. Pricing is subject to change with 30 days' notice.

Deep Search (One-Time): Billed upfront at time of purchase. Non-refundable once search begins processing.

Continuous Monitoring (Subscription): Recurring monthly charges. Renews automatically unless cancelled. You may cancel at any time via your account dashboard or by contacting support.

Payment Processing: All payments are processed by Stripe (stripe.com). You authorize us to charge your payment method for all fees owed. Stripe handles all payment data; we do not store your complete card information.

Taxes: You are responsible for any applicable sales tax, VAT, or other taxes. If you are exempt, you must provide valid tax documentation.

9. Intellectual Property Rights

Company IP: All content, code, design, functionality, trademarks, and intellectual property related to the Service are owned by FindThemOnline, Inc. or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal use only.

Your Data: You retain ownership of User Data you upload. By uploading User Data, you grant us a worldwide, royalty-free license to use it for providing the Service, including analysis, reporting, and quality improvement.

Reports: Investigation reports are for your personal use only. You may not republish, redistribute, or resell reports without our written consent.

10. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FINDTHEMONLINE IS NOT LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, lost revenue, or lost business opportunities
  • Reputational harm or emotional distress
  • Inaccurate, incomplete, or misleading information in reports
  • Third-party claims arising from your use of the Service
  • Service interruptions, delays, or unavailability
  • Unauthorized access or data breaches (except due to our gross negligence)

LIABILITY CAP: Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

WE DO NOT GUARANTEE THAT:

  • Any Target will be located or identified
  • Results will be accurate, complete, current, or uninterrupted
  • The Service will be error-free or secure
  • Any defects will be corrected
  • The Service will meet your expectations

12. Indemnification

You agree to indemnify, defend, and hold harmless FindThemOnline, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including attorney fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your User Data or content you upload
  • Your unlawful conduct or harassment of any individual
  • Your violation of any third-party rights
  • Your violation of applicable law

13. Termination & Account Suspension

Termination by You: You may terminate your account at any time by deleting your account via the dashboard or emailing support.

Termination by Us: We may suspend or terminate your account immediately without notice if you:

  • Violate these Terms
  • Engage in harassment, threats, or illegal activity
  • Misuse the Service
  • Fail to pay applicable fees
  • Compromise our security or integrity

Upon termination, your access to the Service ceases immediately. Your User Data will be retained and deleted in accordance with our Privacy Policy and Data Retention Schedule.

14. Data Protection & Privacy

Your use of the Service is governed by our Privacy Policy and GDPR Compliance Statement. By using the Service, you consent to our collection, processing, and storage of your data as described in those policies.

15. Third-Party Links & Services

The Service may contain links to third-party websites, applications, and services. We do not endorse or control these third-party services. Your use is subject to their terms and privacy policies. We are not responsible for their content, accuracy, or conduct.

16. Modifications to Terms & Service

We reserve the right to modify these Terms at any time. Material changes will be posted with 30 days' notice. Your continued use of the Service after modifications constitutes acceptance of the revised Terms. If you do not agree to modifications, you may terminate your account.

We may modify, suspend, or discontinue the Service at any time with or without notice. We are not liable for any suspension or discontinuation.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You irrevocably consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

This choice of law and jurisdiction provision shall NOT apply if it would make this choice unenforceable under applicable law, including GDPR or other consumer protection laws in your jurisdiction.

18. Dispute Resolution & Arbitration

Informal Resolution: Before initiating legal action, you agree to contact us at support@FindThemOnline.com to attempt informal resolution within 60 days.

Binding Arbitration: Except for claims arising under GDPR or consumer protection laws, any dispute shall be resolved by binding arbitration administered by JAMS under its Comprehensive Arbitration and Mediation Services Rules & Procedures. The arbitration shall be conducted in New York County, New York.

You waive the right to jury trial and class action participation.

19. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, along with our Privacy Policy and GDPR Statement, constitute the entire agreement between you and FindThemOnline regarding the Service and supersede all prior negotiations, understandings, and agreements.
